1. Objet
Within the frame-work of the 2021 Public Investment Budget, the Contracting Authority (the Lord Mayor Wum Council), hereby representing the State of Cameroon, launches an Open National Invitation to tender for the Rehabilitation of the Road linking Magha-Wazob-Zonghofu in Wum Sub Division, Menchum Division North West Region.

2. Consistance des prestations
The works subject of this Invitation to Tender shall require the Rehabilitation of the Rehabilitation of the Road linking Magha-Wazob-Zonghofu in Wum Sub Division, Menchum Division North West Region. The works and service required are found in the detail description mentioned in the respective bills of quantities and cost estimates. These are:

The main tasks to be carried out shall include the following:

– Preliminary works

– Cleaning of site Excavation

– Supply of materials and construction of structures

– Grading and widening of road

-Creation of side ditches

– Backfilling with laterite

– Cambering and compaction

3. Coût prévisionnel
The estimated cost of the operations (tasks) following feasibility studies stands for twenty seven million (27 000 000) CFA Francs.

4. Délai de livraison
The maximum execution deadline provided for by the Project Owner for the execution of the works subject of this tender shall be ninety (90) calendar days with effect from date of notification of the Service Order to start execution.

5. Allotissement
The works subject of this invitation to tender shall be in one lot defined with specifications as in the table below: Rehabilitation of the Road linking Magha-Wazob-Zonghofu in Wum Sub Division, Menchum Division North West Region.

6. Participation et origine
Participation in this invitation to Tender is open to all registered and qualified companies or groups of companies based in the Republic of Cameroon with the required technical and professional expertise in the domain of earth roads maintenance accompanied by the necessary financial capability.

7. Financement
Works, which form the subject of this Invitation to Tender, shall be financed as per the programmed budget head of the 2021 Public Investment Budget (PIB 2021) of the Republic of Cameroon.

8. Consultation du dossier

Each bid written in English or French shall be signed by the bidder or by a duly authorized Representative and presented in seven (7) copies that is one (01) original and six (06) copies labelled as such. These shall be submitted in one sealed external envelope containing three (3) envelopes, that is, Envelope A: Administrative Documents, Envelope B: Technical documents and Envelope C: Financial documents. It shall reach the Wum council in the service in charge of contract award not later than 19 February 2021 at 10 am local time. The sealed external envelope shall be free of all identification marks, failing which it shall be rejected.

Reference documents

In the study and execution of the Jobbing Order, the successful bidder shall comply with the following:

-Statutory and regulatory instruments (laws, ordinances, decrees, orders)

– Unified technical documents (requirements, special conditions, designing rules)

– French norms approved by ARNOR Security rules and norms relating to public protection

– Agreements, technical opinion and recommendations of the CSTB applicable to works relating to this invitation to tender in force on the date of signature of this Jobbing Order.

To carry out the general control of works, the Project Engineer and the other administrations involved in the follow-up of the project may make regular or unexpected visits to the site.

The description of estimates is intended to spell out the technical requirements for a proper execution of the construction works.

The controller shall strictly comply with the description of estimates in keeping with rules and norms.

11. Cautionnement provisoire
Each bidder shall enclose in his administrative documents a bid bond issued directly in the bidder’s name by a first rate bank approved by the Ministry in charge of Finance and that shall respect the model in this tender file featuring on the list in document 12 of the tender file and valid for sixty (60) days beyond the original date of the validity of the offers for amount of two hundred four thousand (284 000) CFA Francs

12. Recevabilité des offres
Under risk of being rejected, administrative documents must be produced in originals or true copies certified by the issuing services of the required administrative documents (Examples: Taxation Officials. “Bank Officials, etc.) or by Administrative Authorities as the case may be (Example: SDO. DO etc…) and must imperatively be produced in accordance with the Special Tender Regulations. They must obligatorily not be older than three (03) months or must not be produced after the submission of the tender tile. Double certification shall not be accepted. Any bid that shall not be in conformity with the prescriptions of this police and tender file shall be declared null and void, especially bids containing a bid bond not issued directly in the bidder’s name by a first rate bank approved by the Ministry in charge of Finance. The bid bond which shall only be released by the Contracting Authority shall be released for unsuccessful bidders not later than thirty (30) days after the period of bid validity. For the successful bidder to whom the contract will be awarded, the Bid Bond shall be returned to the contractor by the Contracting Authority once the final bond has been provided.

Bidders shall remain committed to their offers for a period of ninety (90)days from the last date for the submission, that is the tenders shall be valid for 90 (ninety) days with effect from their submission deadline

NB: The contractor shall, present the originals of the respective certified documents for strict verification of their authenticity during site installation.

13. Ouverture des plis
Bids shall be opened by the Tenders Board in a single phase on the 19 February 2021 at 11 am local time in the conference hall of the Wum council premises. Only bidders or their authorized representatives having a perfect knowledge of the file may attend the bid opening session. Note should be taken that in case of any ambiguities or differences during opening, only the original shall be considered authentic, that is, any bid which shall not comply with the requirements of the tender file shall be rejected.

14. Critères d’évaluation
Tender conformity shall be evaluated as per the following:

A) Eliminatory Criteria

-Offers (bids) submitted after the deadline or time limit;

– Bids submitted in unsealed external envelopes;

– Extemal envelopes with identification marks or inscriptions;

– Administrative Documents more than 3months old;

– Absence of original or properly certified Administrative Document or documents certified more than one time;

– False declaration or forged documents;

– Absence of bid bond or bid bond not issued directly in bidder’s name by a first rate bank approved by the Ministry in charge of Finance;

NB: Bid bond for a group of enterprises must bear the name of mandated enterprise with the names of the other enterprises mentioned as well;

-Execution period longer than prescribed in the Tender file Technical evaluation mark less than 75% (non-respect of 75% of the essential criteria);

– Absence of quantified unit price (omission of a unit price in the financial bid).

B) Essential Criteria

They are primordial or key modalities in the judgment of the technical and financial capacity of candidates to execute the tasks forming the subject of the invitation to tender. They were determined in relation to the nature and content of the tasks to be executed. Hence in the evaluation of:

– (i) Technical documents, it shall be the binary method (YES or NO) based on the following distribution of points:

-Any Bid that shall not obtain 75% evaluation in the technical documents shall simply be rejected.

-Details of these main qualification criteria are specified in the evaluation grid found in the Special Tender Regulations (RPAQ).

(ii) Financial Offer, it shall consist of going through the bill of quantities in reference to the unit price schedule and the sub detail of unit prices.

15. Attribution
The contract shall be awarded to the lowest bidder who must have fulfilled the administrative, technical and financial requirements.

16. Durée de validité des offres
Bidders shall remain committed to their offers for ninety (90) days from the deadline set for the submission of tenders (offers).

8. Special Technical Clauses initialed on all the pages and signed at the last page;

15. Attribution
This evaluation will be done in a purely positive way (yes) or negative (no) with an acceptable minimum of at least 75% of the essential criteria taken in account.

The contract will be awarded to the bidder who would have proposed the offer with the lowest amount, in conformity with the regulations of the Tender Documents and having satisfied to 100% of the eliminatory criteria and at least 75% of the essential criteria.

1. Objet
Dans le cadre de l’exécution du Budget d’Investissement Public de l’exercice 2021, le Maire de la Commune de Yabassi lance un Appel d’Offres National Ouvert en procédure d’urgence pour la réalisation des travaux DE REHABILITATION DE LA ROUTE NKONGMALANG-BONABA-BONADISSAKE (L=5,200 KM) DANS LA COMMUNE DE YABASSI.

2. Consistance des prestations
Les travaux, objet du présent Appel d’Offres comprennent tous les tâches prévues au cadre du devis quantitatif et estimatif

3. Coût prévisionnel
Le coût prévisionnel de l’opération à l’issue des études préalables est de 50 000 000 Francs CFA.

4. Délai de livraison
Le délai maximum d’exécution prévu par le Maître d’ouvrage pour la réalisation des travaux est de quatre (04) mois à compter de la notification de l’ordre de service pour le démarrage.

La participation à cet Appel d’Offres est ouverte à égalité de conditions, aux entreprises de droit camerounais disposant de capacités techniques et financières pour la réalisation des travaux de Bâtiments et de Travaux Publics.

Les prestations, objet du présent Appel d’Offres, sont financées par le Budget d’Investissement Public (BIP), exercice 2021 de la République du Cameroun, sur la ligne d’imputation budgétaire

9. Acquisition du dossier

11. Cautionnement provisoire
Chaque soumissionnaire devra joindre à ses pièces administratives, une caution de soumission établie par une banque de premier ordre agréée par le Ministère chargé des finances et dont la liste figure dans la pièce 11 du DAO, dont le montant est de un million : 1 000 000 F CFA) ; et valable pendant trente (30) jours au-delà de la date originale de validité des offres.

12. Recevabilité des offres
Sous peine de rejet, les pièces du dossier administratif devront être impérativement produites en originaux ou en copies certifiées conformes par le service émetteur ou une autorité administrative agréée à cet effet, conformément aux stipulations du Règlement Particulier de l’Appel d’Offres. Elles doivent dater de moins de trois (03) mois précédant la date originale de dépôt des offres ou avoir été établies postérieurement à la date de signature de l’Avis d’Appel d’Offres.
Toute offre incomplète conformément aux prescriptions du présent avis et du Dossier d’Appel d’Offres sera déclarée irrecevable. 13. Ouverture des plis
L’ouverture des offres aura lieu le 10 FEVRIER 2021 à 12 heures et se fera en un (01) temps, par la Commission Interne de la Commune de Yabassi, dans la salle de réunion de la Mairie de YABASSI. Seuls les soumissionnaires peuvent assister à cette séance d’ouverture ou s’y faire représenter par une personne de leur choix dûment mandatée, ayant une bonne connaissance du dossier.

15. Attribution
Le marché est attribué au soumissionnaire le moins disant (hors taxes) dont l’offre aura été reconnue conforme au Dossier d’Appel d’Offres et remplissant les capacités techniques et financières requises.

16. Durée de validité des offres
Les soumissionnaires restent engagés par leurs offres pendant un délai de quatre-vingt-dix (90) jours à compter de la date limite fixée pour la réception des offres.

Les travaux objet de l’Appel d’Offres, sont financés par le Budget d’Investissement Public Exercice Budgétaire 2021.

8. Consultation du dossier
Le dossier d’Appel d’Offres National Ouvert peut être consulté aux heures ouvrables auprès de la Mairie de NGUIBASSAL (secrétariat général) dès publication du présent avis d’appel d’offres.

9. Acquisition du dossier
Le dossier d’Appel d’Offres National Ouvert peut être obtenu à la Mairie de NGUIBASSAL (secrétariat général) dès publication du présent Avis, contre présentation d’une quittance de versement du Receveur Municipal de la commune de NGUIBASSAL d’un montant non remboursables de 75 000F (soixante-quinze mille francs) CFA.

10. Remise des offres
Chaque offre rédigée en français ou en anglais et en sept (07) exemplaires, dont un (01) original et six (06) copies marqués comme tels, devra parvenir à la Mairie de la commune de Nguibassal au plus tard le 16 Février 2021 à 12 heures précises contre récépissé et devront porter la mention :

11. Cautionnement provisoire
Chaque soumissionnaire devra joindre à ses pièces administratives, un cautionnement provisoire délivré par un établissement bancaire de premier ordre agréé par le Ministère en charge des Finances, dont le montant est fixé à :

Sous peine de rejet, le cautionnement provisoire devra être impérativement produit en original datant d’au plus trois (03) mois.
Le cautionnement provisoire sera libéré quinze (15) jours après la publication des résultats et au plus tard trente (30) jours après le délai de validité des offres pour les soumissionnaires n’ayant pas été retenus. Pour le soumissionnaire attributaire du marché, le cautionnement provisoire sera libéré après constitution du cautionnement définitif.

12. Recevabilité des offres
Sous peine de rejet, les pièces administratives exigées doivent être produites en originaux ou en copies certifiées conformes par les services émetteurs, selon le cas, suivant les indications du RPAO. Elles devront être datées d’au plus trois (03) mois à l’ouverture des plis ou établies postérieurement à la date de publication de l’avis d’appel d’offres.
La soumission dûment timbrée et signée, selon le modèle contenu dans le dossier d’appel d’offres, fera ressortir les coûts en francs CFA hors taxes et toutes taxes comprises.

13. Ouverture des plis
L’ouverture des plis se fera en un temps le 16 Février 2021 à partir de 13 heures précises par la Commission Interne de Passation des Marchés siégeant dans la salle de réunions de la Mairie de Nguibassal en présence des Soumissionnaires ou un de leurs représentants dûment mandatés ayant une parfaite connaissance des dossiers dont il a la charge.

14. Critères d’évaluation

• l’absence de la caution de soumission ;

• Dossier n’ayant pas obtenu, au terme de l’analyse technique, 80% soit 21 éléments positifs (oui).

Evaluation des offres techniques
L’évaluation de l’offre technique portera sur les critères essentiels énoncés ci-dessous :

Evaluation des offres financières
Seules les offres financières des soumissionnaires ayant fourni une offre technique acceptable seront prises en compte pour l’évaluation financière.

15. Attribution
Le marché sera attribué au soumissionnaire présentant l’offre financière qualifiée, sera évaluée la moins disante et remplissant les capacités techniques et administratives requises. Toute offre non présentée en trois (03) volumes sera purement et simplement rejetée ; il en est de même pour toute offre non conforme au règlement particulier de l’Appel d’Offres (RPAO).

16. Durée de validité des offres
Les soumissionnaires restent engagés par leurs offres pendant un délai de 60 (Soixante) jours à partir de la date limite fixée pour la remise des offres.

9. Recevabilité des offres
Chaque soumissionnaire devra joindre obligatoirement à ses pièces administratives, une Caution de soumission établie par une Banque de premier ordre ou par une compagnie d’Assurance agréée par le Ministère chargé des finances et dont la liste figure dans la pièce 12 du DAO, d’un montant de 3 300 000 (Trois Millions Trois Cent Mille) francs CFA.
A défaut de cette caution de soumission et conformément à l’arrêté N° 093/CAB/PM du 05 Novembre 2002 fixant les montants de la caution de soumission et les frais du dossier d’Appel d’Offres, les PME à capitaux et dirigeants nationaux peuvent produire une hypothèque légale.
Sous peine de rejet, les autres pièces administratives requises devront être impérativement produites en originaux ou en copies certifiées conformes par le service émetteur conformément aux stipulations du Règlement Particulier de l’Appel d’Offres.
Elles devront obligatoirement avoir été établies postérieurement à la date de lancement de l’Appel d’Offres.

10. Ouverture des plis
L’ouverture des plis se fera en un temps. L’ouverture des pièces des Offres Administratives, Techniques et Financières aura lieu le 21/12/2020, à 13 Heures précises, par la Commission Départementale de Passation des Marchés (CDPM) du Moungo, dans la salle de conférence de la Préfecture de Nkongsamba.
Chaque soumissionnaire peut assister à cette séance d’ouverture ou s’y faire représenter par une personne de son choix dûment mandatée, ayant une connaissance parfaite de ses offres.

11. Critères d’évaluation

Critères éliminatoires :
a) Absence de la caution de soumission ;
b) Absence après un délai de 48 heures après le dépôt des offres, d’au moins une des pièces du dossier administratif à l’exception de la caution de soumission ;
c) Non-conformité après un délai de 48 heures après le dépôt des offres, d’au moins une des pièces du dossier administratif ;
d) Fausse déclaration, ou pièce falsifiée quel que soit le Dossier. À cet effet, l’Autorité Contractante et la CDPM se réservent le droit de procéder à l’authentification de tout document présentant un caractère douteux ;
e) Non acceptation des clauses du marché (CCAP et CCTP non paraphés à chaque page, non signés et non datés à la fin) ;
f) Offre Technique incomplète pour absence de :

• Rapport de visite de lieux ;
• La déclaration sur l’honneur attestant que le soumissionnaire n’a pas abandonné un marché au cours des trois dernières années, et qu’il ne figure pas sur la liste des entreprises défaillantes établies par le MINMAP ;
• Un Conducteur de travaux ayant la qualification exigée dans le dossier d’Appel d’Offres ;

g) Non existence dans l’offre technique de la rubrique « organisation, méthodologie et planning » ;

h) Omission d’un prix unitaire quantifié dans le BPU et le DQE ;

i) Offre Financière incomplète pour absence de l’une des pièces suivantes :

• Une soumission ;
• Le bordereau des prix unitaires (BPU) suivant le modèle avec indication des prix hors TVA en chiffres et en lettres, rempli de manière lisible ;
• Le détail quantitatif et estimatif (DQE) ;
• Le sous-détail des prix unitaires ;

j) Non obtention d’au moins 23 Oui /28 soit au moins 80% des critères essentiels.

i) Références de l’Entreprise ;
ii) Disponibilité du matériel et des équipements essentiels ;
iii) Expérience du personnel d’encadrement ;

Chaque offre pour être déclarée conforme techniquement doit avoir satisfait à tous les critères éliminatoires et obtenu au moins 23 Oui /28 soit au moins 80 % des critères essentiels énumérés ci-dessus, évalué conformément à la Grille de notation des Offres techniques.

12. Attribution
Le Maire de la Commune d’arrondissement de Nkongsamba 1er, Autorité Contractante, attribuera la Lettre Commande au soumissionnaire dont l’Offre, techniquement qualifiée, aura été évaluée la moins-disante (pas anormalement basse) après vérification et correction uniquement de ses prix et jugée substantiellement conforme à l’ensemble du Dossier d’Appel d’Offres.

13. Durée de validité des offres
Les soumissionnaires restent engagés par leur offre pendant une durée de 90 jours à compter de la date fixée pour la remise des offres.
